Data controller
The controller of your data is Fallwen Search, the trade name of a self-employed professional established in Spain.
- Owner:
- Fallwen Search
Contact email: info@fallwen.com
We have not appointed a data protection officer because our activity does not require one.
What data we process, why and for how long
Waitlist
- Data: your answers in step 1 of the form (platform, catalog size, how your customers search, what you measure and what you want to achieve), your name, your email, your store’s website and, if you give them to us, your role and your phone number. We also keep the language of the website, the page from which you reached the form and the internal priority we give your request.
- If you accept analytics cookies, we also store where your visit came from: the campaign parameters (UTM) of the link you followed and the site you came from (only its domain, not the specific page).
- Purpose: to manage your place in early access, to review your store’s public website and its catalog so we can prepare the demo with your products, to contact you and to send you the confirmation email. Your sign-up is only complete once you confirm your email with the link we send you.
- Legal basis: taking steps at your request prior to entering into a contract, under Article 6(1)(b) of Reglamento (UE) 2016/679 (GDPR). You are asking to see Fallwen with your products before deciding whether to sign up.
- Priority: we use your step 1 answers to rank requests and decide the order in which we contact each store. It is an internal ranking: it does not remove you from the list or produce legal effects concerning you, so it is not an automated decision of the kind covered by Article 22 GDPR.
- Retention: for as long as early access lasts and, at most, 12 months from our last contact if you do not become a customer. After that, we keep the data blocked, available only to meet legal obligations, for the statutory periods set by Article 32 of Ley Orgánica 3/2018 (LOPDGDD), Spain’s data protection act, and delete it once those periods end.
Marketing communications
- Data: your name and your email.
- Purpose: to send you news about Fallwen, only if you tick the box “I’d like to receive news about Fallwen.” You do not need to tick it to join the waitlist.
- Legal basis: your consent (Article 6(1)(a) GDPR and Article 21 of Ley 34/2002 (LSSI-CE), the Spanish Information Society Services and E-commerce Act).
- Unsubscribing: whenever you like, using the link in every email or by writing to us at info@fallwen.com. Withdrawing your consent does not affect emails sent before.
- Retention: until you unsubscribe.
Email inquiries
- Data: your email and whatever you tell us in your message.
- Purpose: to reply to you.
- Legal basis: handling your request (Article 6(1)(b) GDPR).
- Retention: for as long as needed to reply to you.
Website security
- To prevent abuse, the form accepts a limited number of submissions per hour from each connection. To count them, the server keeps your IP address in memory for one hour and does not store it.
- The server’s technical logs are kept for as long as needed to detect and resolve security incidents.
- Legal basis: our legitimate interest in protecting the website and preventing abuse (Article 6(1)(f) GDPR).
Website analytics
- Tool: Google Analytics 4, only if you accept analytics cookies.
- Data: the pages you visit, how you reached the website, your device and browser type, your approximate location and some actions on the website, such as opening a question, using the calculator or submitting the form. All of it is linked to a random identifier stored in the Google Analytics cookies.
- We do not send Google your name, your email, your store’s website, your phone number or what you type in text fields. We do not enable Google Signals or advertising features.
- Purpose: to understand how the website is used and improve it.
- Legal basis: your consent (Article 6(1)(a) GDPR and Article 22(2) LSSI-CE). You can withdraw it at any time from Cookie settings.
- Retention: the cookies last 13 months and Google Analytics keeps the data from each visit for 2 months.
Recipients
We do not disclose your data to third parties unless the law requires us to. To provide the service, we rely on the following processors, which only use the data on our instructions:
- OVHcloud (OVH SAS), which hosts the website, the internal service that stores waitlist requests and sends the confirmation email, and the product, on servers located in France (European Union).
- Google Ireland Limited, which provides the Google Analytics service, only if you accept analytics cookies.
International transfers
There is only one: if you accept analytics cookies, Google LLC, in the United States, may access Google Analytics data. Google LLC is certified under the EU-US Data Privacy Framework (opens in a new window), recognized by European Commission Implementing Decision (EU) 2023/1795, and also applies standard contractual clauses.
All other data stays within the European Union.
Your rights
You can exercise the following rights over your data at any time:
- access: to find out what data of yours we process;
- rectification: to correct any data that is inaccurate;
- erasure: to ask us to delete it;
- objection: to ask us to stop processing it;
- restriction: to ask us to keep it without using it while a complaint is resolved;
- portability: to receive it in a commonly used format or have us send it to someone else;
- withdrawal of consent: without affecting what we did with it before.
To exercise them, write to us at info@fallwen.com. We will reply within one month at most. If we have reasonable doubts about your identity, we may ask you to prove it.
If you believe we have not handled your data properly, you can lodge a complaint with the Agencia Española de Protección de Datos, the Spanish Data Protection Agency (www.aepd.es (opens in a new window), C/ Jorge Juan 6, 28001 Madrid, Spain).
Accuracy of your data and third-party data
The data you give us must be true and up to date. If you give us someone else’s data, for example because you are an agency signing up on behalf of a store, you must have informed them beforehand and have their permission.
Minors
Fallwen Search is aimed at businesses. We do not knowingly collect data from children under 14 and, if we find any, we delete it.
Security and changes to this policy
We apply technical and organizational measures appropriate to the risk: the website and the form use an encrypted connection (HTTPS), and the internal waitlist service only accepts authenticated submissions from this website.
We may update this policy. We will publish each version here with its date and, if a change significantly affects how we process your data, we will let you know.
This website is available in Spanish, English, German and French. If there is any discrepancy between the versions, the Spanish version prevails.
